Rule 12
Procedure to be followed in removal of Executive Head
:
(1) If the executive head does not perform the work in accordance with sub-section (4) of section 14 of the Act, the committee will form a three-member inquiry sub-committee, including members of the committee, to investigate the matter.
(2) The inquiry sub-committee as per sub-rule (1) may, in the course of inquiry, summon the executive head and other related persons to make necessary inquiries, take statements and submit necessary documents and evidence.
(3) The inquiry sub-committee shall submit the inquiry report to the committee along with its opinion after the completion of the inquiry.
(4) Sub-rule (3) If it appears from the investigation report submitted by the Wamojim Investigation Sub-Committee, that the Executive Chief has taken any actions that are contrary to the interests of the Board or has not carried out the work in accordance with the policy instructions of the Committee, the Committee shall submit an explanation to the Executive Chief. Aadhaar should be opened and the notification should be given by giving the time of Manasiv Mafiq. If the executive head does not submit any explanation within that period or if the explanation submitted by him is not satisfactory, the committee may remove the executive head from his post.
(5) After the investigation sub-committee has been formed to investigate the allegations against the executive head under this rule, until the investigation work is completed, if the committee feels that it would be against the interest of the board if the executive head performs his official duties, the committee may suspend or prevent the executive head from carrying out his official duties.
(6) If it is proven that the executive head has knowingly caused damage to the board, the board shall take necessary action to recover such damage from him.
